John is a midlevel manager at Corporation C, a publicly traded Fortune 500 company. As per company policy, the board of directors has adopted a strict code of ethics to be followed by all directors and employees. Recently, John heard that the board of directors had turned a blind eye to illegal maneuvers performed by certain employees, which resulted in a 15% increase in profit for Corporation C in 2015, and a promotion for the employees who engaged in the illegal behavior. John interpreted this to mean that the board of directors condoned this behavior, and that it might even result in a promotion for John if he carried it out successfully himself. Unfortunately, John is caught by federal investigators, who also discover the illegal behavior of the other employees of Corporation C, and the actions of the board of directors in condoning illegal activity. The federal investigators must decide who to charge with a crime: members of the board of directors who condoned and tacitly encouraged illegal behavior, or John and the other employees who engaged in the behavior. What should the federal investigators do?
