Prior to the passage of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, it was relatively easy for debtors to be relieved of much of their debt by declaring bankruptcy. It was so easy in fact, many people would make a bankruptcy part of their financial plan. In a 500+ word paper, discuss the source (where did it come from) and purpose of bankruptcy law in the U.S. Explain what you know about BAPCPA that makes it harder for a debtor to go through a bankruptcy. Since bankruptcy in allowed by the U.S. Constitution do you think the new law making it much harder to take advantage of bankruptcy protection is even constitutional? Is Congress allowed to make new laws in this area? How do you feel about the ethics of bankruptcy in general? Is it ethical to avoid paying back your debts in this manner?
