Based on your reading of chapters nine and ten of the text, the Bahamas Sexual Offences Act - Chapter 99, and the Bahamas Sexual Offences Amendment Act 2011,
1. In a drunken fight, Dee stabs Phil in the hand with her penknife. She told the police she thought the knife was so blunt that it could only cause a tiny scratch. Unfortunately she almost severs his finger and he has to undergo a series of operations. Discuss Dee's liability.
2. Dee deliberately hits Phil on the head with a wooden spoon, but she does not foresee any harm resulting to him. Surprised, he slips and fractures his skull. What offence(s) has Dee committed?
3. After a filthy row, Dee locks Phil in an upstairs room, telling him that he can 'wait there while I go and get something that will really sort you out'. Phil tries to escape through the window but falls and breaks both his legs. Dee says that she had no intention of injuring Phil but had merely wanted to frighten him. Discuss.
4. Dee fires her gun wildly into the air at night in a public park not thinking about the risks involved. She tells the police later that she was sure that no one normally wanders through the park at night. Phil is badly wounded in the chest. Discuss Dee's liability.
5. Dee points a toy pistol at Phil, who does not realize the gun is a toy and is very frightened. He is a weapons expert and therefore should have known that it was a toy. Discuss Dee's liability
6. What offences are committed in the following circumstances:
Dee persuades Phil aged 15 to have sex with her.
Dee encourages Dave to have sex with Viola (aged 15). Dave presumes without thinking that Viola is consenting. In fact, Viola only allows him to have sex with her because Dee has threatened to beat her up if she does not.
7. Dave, angry that one of his lovers has infected him with the AIDS virus, has sex with as many people as he can. Discuss his liability in the following circumstances:
He informs Ann that he has AIDS, and she decides to have sex with him anyhow.
He does not tell his wife, Beth, that he has the virus, and she says that she would not have consented to have sex had she known the truth.
He has anal sex with Charles, who says that while he consented to rough sexual play with Dave, he never consented to the intercourse.
8. At a wild party, Dee encourages Dave to have sex with Violet. Violet is dragged screaming and kicking by Dave into a bedroom, where he pulls off most of her clothes. Dee stands around laughing, but others arrive to save Violet before intercourse takes place. Discuss.
