Scenario

Tony Garcia has worked for his department for nearly 25 years, starting as a customer support officer and working through the ranks to supervise a work team of 12. He has always received above average annual performance ratings. Soon after celebrating his 60th birthday, Tony hears his supervisor, Tom Stackpole, criticising his work in front of other staff members. Tom also gripes that older staff members are just too set in their ways to adapt to the changes sweeping through the organisation. Tony later complains that he is not scheduled for training in the new software being introduced to facilitate the efficient processing of customer requests. After he has expressed his dissatisfaction, he and several other long-serving employees are assigned to the last training session (even though places are available in earlier training sessions). When Tony again complains, Tom says that older workers like Tony are harder to train and suggests that with all the changes being implemented, it is time to consider retirement and give the younger employees a chance. Tony threatens to take the matter to the Equal Opportunity Tribunal.
