Alcott and Jacks entered into an oral agreement by which Jacks promised to take care of Alcott for the rest of Alcott's life and in return Alcott promised to leave upon his death all his real estate to Jacks. Alcott died several years later leaving a will whereby he gave all his real estate to Barbour and appointed Barbour executor. Jacks had fully performed her part of the agreement and, upon learning the above facts, promptly sued Barbour to compel him to surrender Alcott's real estate to her. Defense: Statute of Frauds. (a) Will Jacks succeed in her suit? (b) Assuming she cannot get the real estate will she have any other remedy?
