Analyze the following two scenarios and determine if any crimes have been committed. Assuming a crime was committed, identify any affirmative defenses the defendants may have. Be certain to list any facts that support the elements of any crimes alleged. Use the appendix in your text for substantive crimes and course supplemental materials for Affirmative Defenses. There should be plenty of crimes and defenses to discuss :) Scenario One (30 points): Damion, aged 8, and his brother Dylan aged 6, hate their baby sitter Myrtle aged 68. Damion suggests to Dylan that if they poured vanilla extract into Myrtle's tea pot, that the vanilla extract would poison and kill her. Dylan agrees and thinks Damion's plan is brilliant. Dylan and Damion find the vanilla extract and Dylan pours about a teaspoon of the vanilla extract into the tea pot. Myrtle comes to baby sit later that day. Myrtle rinses out the tea pot in the sink, fills the pot with water and makes a cup of tea. Myrtle drinks the tea and an hour later has a heart attack and dies. Identify and discuss any crimes, complicity, principality, and defenses that apply.
