Suppose that discovery permits each party (plaintiff and defendant) to accurately assess the expected judgment at trial. Why is a trial economically inferior to settlement when the settlement offer is exactly equal to the expected trial judgment? Now suppose instead that discovery increases the optimism of plaintiffs and this increases the subjective value of their legal claims. What is the consequence for the number of claims that go to trial under the dual optimism model?
