Question

A 23-year-old active Marine who has served two tours of duty in Afghanistan was arrested for carrying a pistol without a permit after arguing with his brother and pulling out a firearm. The penalty for the crime is a mandatory one year jail sentence and no more than ?ve years. The victim; his brother, wants the defendant to get counseling. The defendant has no record and is scheduled to go back to Afghanistan in two months. Assume you are the prosecutor. How would you handle this case? Support your response with resources/citations.
