Arnold owned a city block of vacant land consisting of ten lots, each of which he acquired from different owners. Arnold sold lots 1 through 5 to Developer by grant deed. Developer constructed a strip mall on lots 1, 2, and 3, and built a parking area for 250 cars on lot 4. Lot 5 remained vacant. Developer then sold the developed lots, 1 through 4 and the undeveloped lot to Bren. Bren constructed Jump High, a recreational facility for children, on lot 5. In 2005 Bren turned around and sold lots 1 through 4 to Segre Corporation in which the deed contained covenants. The covenant within the deed stated the following: A. Bren reserves the right for himself, his heirs, successors and assigns that Segre Corporation shall provide, maintain, repair and keep available on lot 4 for the non exclusive use of customers of the "Jump High" recreational facility a parking area for at least 100 automobiles and B. to not allow any other similar recreational facility for children on any of the remaining lots.
