Problem: The Seal family was invited to take a tour of Ocean World by one of the Ocean World employees. The premier attraction at Ocean World was their famous killer whale, Jaws. As the Ocean World employee was giving the Seals a tour of the holding tanks, ten-year-old Pete Seal wandered away from his parents and walked near the edge of the tank where Jaws was held in between shows. Jaws launched himself at Pete, knocked him down and almost seized him. Pete suffered serious physical injuries as a result of the attack by the whale. Pete's parents did not see the incident but heard Pete scream. They rushed over to him immediately after and suffered severe emotional distress when they saw Pete. Is Pete entitled to recover against Ocean World under a strict liability for abnormally dangerous activities/animals theory? Are Pete's parents entitled to recover for their emotional distress under that theory? Of course, you're wondering about the disclaimer that would have been on the tickets for anyone attending Ocean World shows. That's irrelevant because in this case the Seals were guests.
