In regards to the Jesperson v. Harrah's Operating Company, Inc,. 444 F.3d 1104 (9th Cir 2006), the appeal court upheld the validity of a dress code that required females to wear makeup but not males. Research has shown that attractive people make about 14% more than their more unattractive counterparts and that the disparity increases over time.

Are the costs of appearance-related bias justified and/or inevitable? If a person's appearance, like intelligence, produces different opportunities something that we as a society must accept or should the law attempt to reduce this type of bias? Should we expect employers to take reasonable steps to avoid using attractiveness as a proxy for effective job performance?
