Jerry spotted a lovely blackwood bookcase in an antique shop owned by Julie, which had a price tag of $5,000. Jerry approaches Julie and tells her that he cannot accept her offer of $5,000 on the price tag but he can take the bookshelf for $3,000. The conversation then had is as follows:-
• Julie says "that isn't possible but how about $4,500?"
• Jerry says "no, how about $4,000?"
• Julie says "no, if you don't like my prices you are free to shop somewhere else"
• to which Jerry replies "Ok then, I will accept your price of $4,500."
Julie does not reply but turns to serve another customer, as Jerry steps away from the counter to take a call on his mobile phone.
Following his telephone call, Jerry turns back to Julie to pay for the bookcase but Julie says she has already sold it to Katherine for $5,000. Jerry is furious and says that he and Julie had a contract and that the bookcase was his. Advise Jerry and Julie giving reasons for your answer.
