The purpose of this assignment is to assess the understanding of the students on the application of the law of contract to restrictive covenants. A contract of service may contain such a clause which states that in the event of resignation, dismissal or termination, the employee is not allowed to carry a trade or engage in a profession similar to the employer. Students are required to look into the legality of such clause, evaluate it and recommend better solutions to the parties.

TASK :

Students have to identify the main issues regarding the restraint of trade or profession, identify relevant principles from the Contracts Act 1950, and apply the relevant principles to the issue, supported by examples and cases.   

Students are expected to provide their recommendations and conclusion based on the discussion.                                

Assignment Format:

Use double space and 12-point of Times New Roman font.

The assignment should contain about 3000 – 5000 words (15 – 20 pages).

Provide reference using the American Psychological Association (APA) format.

References should be latest (year 2011 onwards).
