Application: HIPAA Versus State Law

Have you ever experienced a sudden, extreme change in the background noise in a certain spot while walking? Maybe the background noise suddenly ceased or drastically increased or decreased. When you moved in any direction, the background noise suddenly returned to normal levels.    

Laws exist at many levels of government. Like sound, laws for protecting private information might seem like they can interact in mysterious ways. Fortunately, well-defined rules exist for resolving these interactions-especially, situations in which conflicts exist.

To prepare for this Assignment, find a state law that protects the security of protected personal information (PPI) and/or protected health information (PHI). Next, study the security standards of the Health Insurance Portability and Accountability Act (HIPAA) and the state law you selected.

For this Assignment, write a 2- to 3-page paper in APA format that:

• Summarizes HIPAA's security standards.
• Summarizes the state law's security standards.
• Explains how an entity operating in that state must comply with HIPAA and/or state law. Be sure to clarify any situation where HIPAA and state law are in conflict.
• Explains to what degree the HIPAA and state law's security standards conform to the CIA (confidentiality-integrity-availability) triad.
