1. Using an applicable criminal case obtained from Westlaw, summarize the legally-relevant facts (as they relate to the elements of the crime) in one to two concise sentences (avoid run-on sentences and the use of multiple punctuations). Embed a properly formatted citation to the case that meets the Uniform Bluebook of Citations Practitioner criteria. In one to two concise sentences, summarize the court's analysis and holding (avoid run-on sentences and the use of multiple punctuations). Focus only on what is relevant to Robert's case. Do not provide a full citation. Instead, use "Id." (either italicized [ Id. ] or underlined [ Id. ], depending on how the party names were formatted in the case law citation).
2. In one sentence, discuss Robert's culpability by applying his facts to the facts from the case that were summarized in (a). The first party's name is used to make the comparison, which serves as the citation. However, in criminal cases, the government is never used, so we always default to the defendant's last name. The goal of case law application/analysis is to demonstrate the similarities (or distinctions) between Robert's facts and the case law facts. Based on that comparison, apply the court's analysis of the actus reus and mens rea elements to Robert's case. For the application of case law, use these words: like, similar to, unlike, etc. Conclude with this sentence: Therefore, based on [case party name], Rober will most likely be charged with [crime]. The crime must be the same crime the defendant was convicted of in the case that was summarized in (a).
