Antonio has worked as a salesman for for Lindenwood Liquors for 13 years. After Antonio is fired from his job, he sues Lindenwood alleging discrimination under the Civil Rights Act and the Age Discrimination in Employment Act. Antonio claims he was fired because of his Mexican heritage and because of his age. Antonio is 55 years old. Lindenwood files a motion to dismiss Antonio's lawsuit alleging he is an independent contractor, not an employee, and therefore, has no valid claim against Lindenwood.
