1. Identify your Case Study
Search the news for a case that connects to asylum seekers in Australia, new anti-terrorism legislation introduced by the Government, the policing of ethnic minorities, or possible cases of police misconduct. You are looking for a real life example which illustrates and brings to life the human right you are discussing within the context of law enforcement/criminal justice.
2. Describe the Case
Provide specific details to describe the case. Where/when it occurred, who were the characters involved, what happened
3. Discuss relevant legislation/policies
Consider what legislation/policies apply to the specific case. For example, if law enforcement agents were involved, which policies were they supposed to abide by? Was any crime being committed? Which human rights legislation or policy would be relevant to the case (e.g. if talking about children, you would probably say something about the CRC or about the YOA)?
4. Critical discussion on the ethical issues
What are the main ethical issues in the case you have selected? For example, whose human rights are at stake? Does the case present a violation of human rights? If it does, was the breach justifiable? You should refer to the four criteria for justifiable limitation of human rights (P.L.A.N., ) to explain why and how the breach of human rights, in your chosen case study, was/was not justifiable.
