Andy Jackson was the registered proprietor of Biggin Hall, a large old house set in extensive grounds. In 1995 he granted a 5-year lease of a cottage (Lark Cottage) in the eastern grounds of Biggin Hall to Tina Henry. In 1996 Andy orally gave Tina permission to share use of a shed attached to Biggin Hall to store firewood. When the lease expired in 2000 Andy sold the freehold of Lark Cottage to Tina. The transfer deed contained no reference to her right to use the shed. In 2005 Andy gave Helen Pettit, his neighbour on the eastern side of Biggin Hall, oral permission to exercise her dog in the grounds of Biggin Hall. Last year Andy sold Biggin Hall to Peter Koumas. Peter has learnt that Helen is proposing to build a two storey extension to her house which will almost completely block out the light to his kitchen. Peter is very angry about this and has told her that she can no longer exercise her dog in the grounds of Biggin Hall.
