It is important that you familiarize yourself with the Supreme Court, as they have the ability to change the Constitution on a daily basis. The following readings and questions should help you to understand what their decisions say and how they come down.
Read the recent Supreme Court case, Alabama Realtors v. Dept. of Health and Human Services, that is also attached to the assignment details in Canvas. The last slide in the Chapter 1 PowerPoint and in Part IV of the Chapter 1 audio should help with some of the question terminology. This is a timely case given our upcoming discussions in the next unit of tort and international law.
Question 1. What is this type of opinion called and who authored pages 1-8 in this case? When was the case decided?
Question 2. Briefly describe the facts of the original case for me that lead us to the Supreme Court, including the results at the lower federal court(s).
Question 3. What was the essential issue (one key question of law) the Supreme Court was addressing?
Question 4. What did the Supreme Court decide (how did they answer the issue question) AND what then happened to the case procedurally after the decision?
Question 5. This was an interesting case procedurally. What was the District Court able to use the second time as justification for changing their prior decision on the stay?
Question 6. List the four traditional "stay factors."
Question 7. What does the opinion say about the potential authority of the CDC based on the Government's interpretation (read) of section 361?
Question 8. What must happen for such a moratorium to be effective going forward?
