Across the country, state legislatures have debated whether their state statutes should be amended to reduce the amount of damages plaintiffs in personal injury cases may recover. For instance, a few years ago, the Idaho Legislature passed a tort reform bill which significantly changed Idaho law. It reduced the cap on noneconomic damages (such as pain and suffering) to $250,000 (down from $682,000). It also put a cap on punitive damages to $250,000, or three times the amount of compensatory damages, whichever is greater. (There had been no previous cap). What do you think about this new law? Is it necessary? Who does it benefit? Who does it harm?
