Question: Stella is the registered owner of a property in Vaucluse NSW. The property is a large three-bedroom house on 1 hectare of land. Stella marries Charles and goes to live in the United Kingdom. Stella organises for the local real estate agent Melissa to act as her agent while she is outside Australia. Melissa, as agent, is responsible for: ?nding a tenant and entering into a tenancy agreement; collecting the rent; sending the rent to Stella monthly; undertaking repairs as necessary; and inspecting the property every six months. Melissa enters into a tenancy agreement with Ferris. Ferris turns out to be a very good tenant and after twelve months Melissa stops doing inspections. She to notice when, after six years, Ferris stops paying the rent. Stella has not received the rent and writes to Melissa asking her what is happening. Melissa advises that she is looking into it and will let her know. Melissa writes to Ferris and advises the rent is in arrears and that it must be brought up to date. Ferris makes a small payment of rent arrears and then promptly stops paying rent again. Stella advises Melissa that she is returning to Australia in January 2023.
