Assignment Brief: Scenario
The developer for the project used in Unit 2 Construction Technology has approached a company of local surveyors to offer advice on the commercial disposal of the buildings on the development. You are to assume the role of trainee surveyor with the surveying company and your manager has asked you to produce a report advising the developer on their legal duties when selling and leasing the buildings on the development.
The developer is proposing to sale the freehold of all the residential properties but lease the commercial and industrial buildings.
Your report should assess how the contemporary land and property law impacts on the disposal of the developer's project. The report should be in two parts with part one considering the disposal of the freehold residential properties, and part twoconsidering the lease agreements for the industrial and commercial buildings.
Your report should advise the developer the legislation covering the purchase and sale of land and property including the key elements of a contract and the different stages of the conveyancing process you should evaluate the legislation in terms of its efficiency in the control of land/property transactions.
Advise the developer on their responsibilities and duties with regards to being a landlord and the corresponding rights and duties of the tenant. As part of this you need to discuss the different types of leases and clauses contained within and evaluate their efficacy in managing the leased property.
