Question 1: Sonny is in quality control at FiFo Appliances. He specialised in coffee machines. His position involves testing all of the coffee machines manufactured. Sonny is one of the best in the business and is extremely reliable, he is also the only one with the skill set do undertake this work at FiFo. When Sonny takes emergency leave, FiFo is left without anyone to manage quality control. John, the owner tries to get in a replacement for Sonny but is unable and so continues producing without quality control. Samantha has purchased on of these coffee machines, but when she has brought it home and plugged in the machine began growing and when she went to disconnect it from electricity it was so hot to the touch that she burnt her hand.

Advise Samantha on her position with reference to torts.

Question 2: Would you answer be different if instead of purchasing the machine for personal use, Samantha purchased the machine for her cafe. The machine has broken down on opening day after Samantha has put in a lot of money on advertising and promoting their guaranteed 2 minute morning coffee turnaround with no waiting. Not only have customers been extremely disappointed, Samantha has also lost a lucrative deal with Kiddo Coffee and leading coffee brand who now don't want to deal with her.
