1. A dispute arose when the National Union of Hotel, Bar and Restaurant Workers representing the workers and the restaurant sought to have the hotel joined as a party in the Industrial Court. The Union alleging that the workers were the employees of the hotel and that they were dismissed and not retrenched as alleged by the restaurant. The subsidiary that employed the workers were no longer in existence, but the hotel was still in operation.
