The Groove Machine was the hottest dance club in Melbourne. In line with its upgrading of facilities, Gary, the owner of Groove Machine purchased the following items at Sound Solutions Pty Ltd:
1. 10 Jaybeeyel high-powered speakers to enhance the sound experience. The cost of the speakers was $30,000.
2. A laser light display unit worth $5,000.
3. A bar showcase for drinks worth $4,000.
All of the items were to be installed by technicians from Sound Solutions. When the goods arrived at Groove Machine, Gary had to sign off a form that signified delivery of items. He noticed a clause that read:
'Sound Solutions accepts no responsibility for goods that do not perform as expected or services that conform to requirements."
He thought this was strange but since he was busy, he signed and returned the form to Sound
Solutions.
After a month of installation of the three items purchased, Gary found that the high-powered speakers were only able to play sounds at low volumes. Gary was actually recommended the particular brand of speakers by John, a salesperson at Sound Solutions. John said, "These speakers are the best when it comes to handling very loud volumes."
The laser light display that was mounted by the technicians, fell from the ceiling of Groove Machine. It was found that the installation had not been carried out properly.
The bar showcase began to rot when liquid came into contact with the wood from which it was made. When Gary questioned Sound Solutions about this, they said that it was the manufacturer's problem. The bar showcase was manufactured by a company called Wooden
Work.
When Gary complained about the speakers and the laser light display unit, Sound Solutions said that they would not be doing anything about it as Gary had signed the form that excluded their liabilities.
