Assignment Brief
Adam is a car dealer and has advertised a 2016 Mercedes A-Class for sale for €30,000. Barry sees Adam's advertisement in the paper and emails him to tell him that he is interested in the car; however, he informs Adam that he is only willing to pay €25,000.
Adam replies to Barry's email and tells him that he will not accept anything less than €30,000 but that he has another car for sale that might interest her, a 2014 Audi A3, which is priced at €22,500.
Barry receives Adam's email and immediately writes a cheque for €22,500 and posts it to Adam with a letter informing him that he will take the Audi A3.
Unfortunately for Barry, by the time the letter arrives, Adam has already sold the Audi AS to someone else.
Advise Barry as to whether a legally binding contract exists between him and Adam.
Identify all the issues which you have studied which arise in this problem and apply them to the facts.
Use relevant case law to substantiate your answer.
