Assessment - Portfolio Problem Statement
RedRock Law is a law firm based in Melbourne, Victoria, specialising in commercial disputes and litigation.
The firm has had a recent spike in the number of creditor's statutory demands being issued against their clients.
Creditor's statutory demands are issued pursuant to section 459E of the Corporations Act 2001 (Cth). Please see annexed to this document an example of a creditor's statutory demand one of the firm's clients was allegedly served with just this week.
Typically, once the client becomes aware of the creditor's statutory demand, the client forwards a copy of the demand to the firm and seeks urgent advice in relation to what options the client has to deal with the creditor's statutory demand.
The firm wants to streamline this process, and as such, they have asked you to create a user-friendly tool for the firm to use to help determine what options the client has based on their particular fact scenario considering the relevant legal principles contained in the Corporations Act 2001 (Cth), including but not limited to considering the following:
1. The service of the creditor's statutory demand on the client;
2. The parties subject to the creditor's statutory demand;
3. The amount of the debt subject to the creditor's statutory demand;
4. The nature of the debt subject to the creditor's statutory demand;
5. The period of time the client has to deal with the creditor's statutory demand;
6. Options available to the client has to deal with the creditor's statutory demand.
