Scenario 1
You are a real estate agent and you are managing a residential property on behalf of the property owner. You have completed an exit property condition report (see file attached to question) for a rental property. You are now meeting with the tenant to discuss the issues contained in the report. Your goal is to address the issues, negotiate for the issues to be rectified and refer unresolved issues for external review.
The tenant has been living in the property for 15 months and they appear to have breached their agreement, based on the current condition of the property. There are no issues related to domestic violence which apply to the scenario. The tenant was present during the entry property condition inspection and is present during the exit inspection. The tenant disagrees with your assessment of some aspects of the condition of the property.

Document the process to negotiate with the tenant for rectification of an escalating dispute with property condition for release of bond.

Part 1)
Take note of the condition report. Identify the issues and discrepancies in a logical order and outline them.
Write an email to discuss these issues with the tenant. Negotiate for the issues to be rectified. Seek agreement from the tenant about the condition report where possible, and show you are able to provide clear and concise information.
You should tell the tenant about their right to make a complaint and how their complaint will be handled.
You should attempt to resolve the disagreement and work towards an outcome which complies with relevant legislation and is satisfactory for all parties.
